1. Introduction and Acceptance of Terms

These Terms and Conditions (hereinafter referred to as "Terms," "Agreement," or "T&C") constitute a legally binding agreement between you (hereinafter referred to as "User," "Player," "You," or "Your") and bmw5 (hereinafter referred to as "bmw5," "We," "Us," or "Our"), operating the online gaming platform accessible at https://bmw5.cam and related mobile applications (collectively referred to as the "Platform" or "Service"). 2. Eligibility and Account Registration

2.1 Age and Legal Capacity Requirements

Use of bmw5 services is strictly limited to individuals who meet all of the following eligibility requirements: (a) You must be at least twenty-one (21) years of age or older, in accordance with the minimum legal gambling age established under Philippine law and PAGCOR regulations; (b) You must possess full legal capacity to enter into binding contracts under the laws of the Republic of the Philippines; (c) You must be physically located within the territorial jurisdiction of the Philippines at the time of accessing or using bmw5 services; (d) You must not be a resident of any jurisdiction where online gaming is prohibited by applicable law; (e) You must not be employed by bmw5, any affiliated entity, game provider, or competitor, nor be an immediate family member of such persons; (f) You must not be listed on any self-exclusion register or banned players list maintained by PAGCOR or other gaming regulatory authorities.

bmw5 reserves the right to request documentary proof of age and identity at any time, including but not limited to government-issued identification cards, passport, driver's license, or other acceptable identification documents. Failure to provide requested verification documentation within the specified timeframe may result in account suspension or closure and forfeiture of account balance and winnings. Any attempt to circumvent age verification procedures, use falsified identification documents, or otherwise misrepresent your age or identity constitutes a material breach of these Terms and will result in immediate and permanent account termination, forfeiture of all funds, and potential reporting to law enforcement authorities.

2.2 Account Registration Process

To access gaming services on the bmw5 Platform, you must complete the account registration process by providing accurate, current, and complete information as requested in the registration form. Required information includes but is not limited to: full legal name as it appears on government-issued identification, date of birth, valid email address, mobile phone number, residential address within the Philippines, and selection of account currency (PHP). You must create a unique username and secure password meeting our specified security requirements. You agree to maintain the confidentiality of your account credentials and accept full responsibility for all activities conducted under your account.

Each individual is permitted to register and maintain only one (1) account with bmw5. Creation or maintenance of multiple accounts, whether concurrently or sequentially, is strictly prohibited and constitutes grounds for immediate termination of all accounts, forfeiture of balances and winnings across all accounts, and cancellation of any bonuses, promotions, or loyalty rewards. bmw5 employs sophisticated duplicate account detection systems, including but not limited to matching of personal information, payment methods, device identifiers, IP addresses, and behavioral patterns. Discovery of multiple accounts will result in closure of all duplicate accounts with only the original account potentially remaining active at bmw5's sole discretion.

3. Account Security and Responsibilities

3.1 User Account Security Obligations

You are solely responsible for maintaining the security and confidentiality of your bmw5 account credentials, including your username, password, and any additional security information such as security questions or two-factor authentication codes. You must not share your account credentials with any third party under any circumstances. You agree to immediately notify bmw5 of any unauthorized use of your account, any security breach, or any other concern regarding account security by contacting our customer support team. bmw5 will not be liable for any loss or damage arising from your failure to maintain adequate account security or from unauthorized access to your account resulting from your disclosure of credentials, use of weak passwords, or failure to properly secure devices used to access the Platform.

You are solely responsible for all activities, transactions, bets, and actions conducted through your account, whether authorized by you or not. bmw5 shall have no liability for any losses incurred due to unauthorized account access resulting from your negligence in maintaining account security. In the event of suspected unauthorized access or fraudulent activity on your account, bmw5 reserves the right to suspend the account pending investigation, reverse suspicious transactions, and take any other measures deemed necessary to protect the integrity of the Platform and other users.

3.2 Prohibited Account Activities

Users are expressly prohibited from engaging in the following activities: (a) Creating or operating multiple accounts to abuse bonuses, promotions, or other Platform features; (b) Allowing any other person to access or use your account for any purpose; (c) Engaging in any form of collusion, cheating, fraud, or other dishonest activity; (d) Using automated systems, bots, scripts, or other third-party software to access or interact with the Platform; (e) Exploiting software bugs, glitches, or vulnerabilities for personal gain; (f) Conducting transactions or gameplay from jurisdictions where online gaming is prohibited; (g) Using the Platform for money laundering or any other illegal activity; (h) Attempting to reverse engineer, decompile, or otherwise tamper with Platform software; (i) Harassing, abusing, or threatening bmw5 staff or other users; (j) Providing false or misleading information during registration or verification processes.

4. Deposits, Withdrawals, and Financial Terms

4.1 Deposits

bmw5 supports deposits through various payment methods popular in the Philippines, including but not limited to GCash, PayMaya, bank transfers via BPI, BDO, UnionBank, Metrobank, and other partnered financial institutions, and cryptocurrency (USDT). All deposits are subject to minimum and maximum limits as displayed on the Platform at the time of transaction. Deposit limits may vary based on payment method, account verification status, and account history. You are responsible for all fees or charges imposed by your payment provider or financial institution for deposit transactions. bmw5 does not charge deposit fees to users, though we reserve the right to implement such fees in the future with advance notice.

All deposits must originate from a payment method registered in your own legal name. Third-party deposits are strictly prohibited. bmw5 reserves the right to reject or reverse any deposit that appears to originate from a third-party source, is suspected of involving fraudulent or stolen payment instruments, or otherwise raises compliance concerns. Deposited funds are intended for gaming purposes only and may be subject to wagering requirements before withdrawal, particularly when bonuses or promotions have been claimed. bmw5 is not a financial institution and does not pay interest on account balances.

4.2 Withdrawals

Withdrawal requests are processed subject to successful completion of account verification procedures, including submission and approval of valid identification documents as required by PAGCOR anti-money laundering (AML) and know-your-customer (KYC) regulations. First-time withdrawals will typically require identity verification before processing. Withdrawals must be made to a payment method registered in your own name that has been previously used for deposits to your account, subject to AML regulations requiring that funds are returned to their source. Minimum and maximum withdrawal limits apply and are displayed on the Platform. Withdrawal processing times vary by payment method, with e-wallets typically processed within 24 hours, bank transfers within 1-3 business days, and cryptocurrency transfers processed promptly upon blockchain confirmation. bmw5 reserves the right to refuse or delay withdrawal requests if suspicious activity is detected, if account verification is incomplete, if bonuses or promotions terms have not been satisfied, if there are unresolved disputes or chargebacks, or if required by law or regulatory directive.

4.3 Bonus and Promotional Fund Restrictions

Funds credited to your account as bonuses, free bets, promotional credits, or loyalty rewards are subject to specific terms and conditions including wagering requirements, game restrictions, maximum bet limits, and expiration periods. It is your responsibility to familiarize yourself with the rules of any game before placing real-money wagers. In the event of a conflict between general Terms and specific game rules, the specific game rules shall prevail. bmw5 uses certified random number generators (RNGs) to ensure fair and random outcomes in all applicable games, including slots, virtual table games, and other RNG-based games. All bets are final once confirmed, and players are responsible for verifying bet details before confirmation. Users engaging in any of the following prohibited practices will be subject to account suspension or termination, forfeiture of funds, and potential legal action: (a) Collusion with other players to gain an unfair advantage; (b) Use of automated betting systems, bots, or artificial intelligence tools; (c) Exploitation of software vulnerabilities or errors for personal gain; (d) Participation in syndicated betting operations; (e) Arbitrage betting or "bonus hunting" across multiple platforms; (f) Any form of chip dumping, especially in poker or other player-versus-player games; (g) Opening multiple accounts to circumvent betting limits or bonus restrictions; (h) Conducting irregular betting patterns that indicate fraudulent activity; (i) Attempting to manipulate game outcomes through any means.

6. Intellectual Property Rights

All content, materials, features, functionality, and intellectual property displayed on or provided through the bmw5 Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, software, data compilations, and the underlying code and structure of the Platform, are the exclusive property of bmw5, its licensors, or its content providers and are protected by Philippine and international copyright, trademark, patent, trade secret, and other intellectual property laws.

bmw5 grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal, non-commercial entertainment purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Platform except as follows: (a) Your computer or device may temporarily store copies of materials in RAM incidental to accessing and viewing those materials; (b) You may store files that are automatically cached by your web browser for display enhancement purposes; (c) You may print or download one copy of a reasonable number of pages for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

Unauthorized use of bmw5 trademarks, service marks, logos, or branding without prior written permission is strictly prohibited and may violate trademark laws.

7. Limitation of Liability and Disclaimers

THE BMW5 PLATFORM AND ALL SERVICES, GAMES, CONTENT, AND MATERIALS PROVIDED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, BMW5 DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BMW5 DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, THAT THE PLATFORM OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BMW5, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM, ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM, OR ANY UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT BMW5 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BMW5'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO BMW5 IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR PHILIPPINE PESOS ONE THOUSAND (PHP 1,000), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.

7.3 Force Majeure

bmw5 shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond bmw5's reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, governmental action, epidemic or pandemic, labor disputes, power failures, internet service provider failures, telecommunications infrastructure failures, cyber attacks, or any other events or circumstances beyond the reasonable control of bmw5.

8. Responsible Gaming and Player Protection

bmw5 is committed to promoting responsible gaming and providing tools to help users maintain control over their gaming activity. 10. Dispute Resolution and Complaints

10.1 Internal Dispute Resolution

10.3 Governing Law and Jurisdiction

These Terms and any disputes arising out of or related to these Terms or your use of the bmw5 Platform shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of the Philippines, and the parties consent to the personal jurisdiction of such courts. Notwithstanding the foregoing, bmw5 retains the right to seek injunctive or other equitable relief in any jurisdiction to protect its intellectual property rights or to enforce these Terms.

11. Account Suspension and Termination

11.1 Termination by User

You may close your bmw5 account at any time by contacting customer support and requesting account closure. Upon account closure, you must withdraw any remaining account balance subject to satisfying any outstanding wagering requirements or other obligations. bmw5 reserves the right to deduct any outstanding fees, charges, or amounts owed before processing final withdrawals. Once your account is closed, you will no longer be able to access any account information, transaction history, or other data associated with the account. Account closure is permanent and cannot be reversed.

11.2 Termination or Suspension by bmw5

bmw5 reserves the right to suspend or terminate your account, refuse service, or restrict access to the Platform at any time and for any reason at our sole discretion, with or without notice, including but not limited to: (a) Violation of these Terms or any other bmw5 policies; (b) Suspected fraudulent, abusive, or illegal activity; (c) Provision of false or misleading information; (d) Failure to complete verification procedures; (e) Excessive chargebacks or payment disputes; (f) Abusive behavior toward staff or other users; (g) Exploitation of software errors or vulnerabilities; (h) Extended period of account inactivity; (i) Regulatory requirement or legal obligation; (j) Business decision to cease operations in your jurisdiction.

Upon account suspension, you will be temporarily unable to access your account pending investigation or resolution of the issue that triggered the suspension. Upon account termination, any remaining account balance will be returned to you (less any amounts owed to bmw5) provided there are no violations of these Terms that warrant forfeiture. bmw5 reserves the right to retain account balances and winnings in cases involving fraud, multiple accounts, bonus abuse, or other serious violations of these Terms. Account termination decisions are final and bmw5 is under no obligation to provide detailed reasons for termination beyond citing violation of Terms.

12. Miscellaneous Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy, Responsible Gaming Policy, and any other policies or guidelines incorporated by reference, constitute the entire agreement between you and bmw5 regarding your use of the Platform and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform.

12.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent to the greatest extent possible. If such modification is not possible, the invalid provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

12.3 Waiver

No waiver by bmw5 of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by bmw5 to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. All rights and remedies provided in these Terms are cumulative and not exclusive of any other rights or remedies provided by law.

12.4 Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without the prior written consent of bmw5. bmw5 may assign, transfer, or delegate these Terms and any rights or obligations hereunder at any time without restriction and without notice to you. Any attempted assignment in violation of this provision shall be null and void.

12.5 Third-Party Rights

These Terms are intended solely for the benefit of the parties hereto and are not intended to confer third-party beneficiary rights upon any other person or entity. No third party shall have any right to enforce any provision of these Terms.

12.6 Language

These Terms are executed in the English language. If these Terms are translated into any other language, the English language version shall prevail in case of any inconsistency or discrepancy.
